LEGISLATION: Ukraine

Our expert on Ukrainian legislation D. Kardashev researched the subject dancing in Kharkiv

I would like to start with the concept of LGBT. LGBT or GLBT is an initialism that stands for lesbian, gay, bisexual and transgender. In use since the 1990s, the term is an adaptation of the initialism LGBT, which was used to replace the term gay in reference to the LGBT community beginning in the mid-to-late 1980s. Activists believed that the term gay community did not accurately represent all those to whom it referred.

The initialism has become mainstream as a self-designation. It has been adopted by the majority of sexuality and gender identity-based community centers and media in the United States, as well as some other English-speaking countries. I firmly believe that our government must legalize the LGBT marriages, and confirming my opinion, I would like to raise some arguments in my essay.

To start with, it’s no use denying that modern society has a tendency to become more tolerant and democratic. To two days ago, I checked the statistics. 2834 Ukrainians took part in the survey answering one question, “Do you support the legalization of same-sex marriage?” "YES" was answered by 1,700 people, "Against" by 1134. So 59.3% are in favour of, and 40.7% are against. What about other countries, in the Czech Republic, the idea of adopting children by same-sex couples is supported by 59% and 39% are against it. Needless to say, that in all progressive countries gay marriages is not forbidden. Right now, Ukraine is going to enter Europe, and everybody knows that fourteen countries of the world out of twenty two, where homosexual marriage is legal, are located in Europe. To sum up my first point, I’d like to emphasize, that all the above mentioned facts clearly demonstrate that the majority of people are not against LGBT marriages.

It’s a sad fact that everyone has heard such things as “it is abnormal!!!”; “religion does not support gay marriages”; “can u realize that your children might become lesbian or gay?!” I can confidently say, that every man and woman must have equal rights not to mention the simple fact that everybody has his or her head on the shoulders and we all live the way we want, and LGBT community is not an exception. Fortunately, the Cabinet of Ministers of Ukraine intends to draft a bill on the legalization of same-sex civil partnership until 2018. The corresponding order No. 1393 of November 23, 2015 was published on the government's website on March 11. By this document, the Cabinet approved an action plan for the implementation of the National Human Rights Strategy for the period until 2020. One of the points of the plan is “the development and submission to the Cabinet of Ministers of Ukraine of a bill on the legalization of a registered civil partnership in Ukraine for same-sex and same-sex couples, taking into account property and non-property rights, in particular, possession and inheritance of property, keeping one partner in the case of disability, constitutional right of non-certification against one's partner.”

Summing up everything I have told, I would like to make a conclusion that LGBT marriages must be legalized in Ukraine, because nowadays the rights of gays, lesbians, bisexuals and trans genders are impaired which is clearly unfair and non-European.
